    Confidential Information includes, but is not limited to:

    • Technical specifications, processes, and methodologies

    • Proprietary software, algorithms, and intellectual property
    • Personnel information and organizational structures
    • Any information marked as confidential or that would reasonably be considered confidential

    3. Non-Disclosure Obligations

    Enancial LLC agrees to:

    • Not disclose confidential information to any third parties without written consent
    • Use confidential information solely for the purpose of providing agreed-upon services
    • Return or destroy all confidential materials upon completion of engagement
    • Maintain confidentiality obligations even after termination of services

    4. Exceptions to Confidentiality

    Information may be disclosed if:

    • Required by law, court order, or government regulation
    • Information becomes publicly available through no fault of Enancial LLC
    • Information was independently developed without use of confidential information
    • Written consent is provided by the client

    5. Data Retention and Disposal

    • Confidential information is retained only as long as necessary for service delivery
    • Secure disposal methods are used for all physical and digital materials
    • Clients may request confirmation of data destruction upon engagement completion
    • Backup systems are subject to the same confidentiality and disposal protocols

    6. Breach Response

    In the unlikely event of a confidentiality breach:

    • Immediate notification to affected clients within 24 hours
    • Comprehensive investigation and documentation of the incident
    • Implementation of corrective measures to prevent future breaches
    • Cooperation with any required legal or regulatory responses
